Luchtvaartfaciliteitengelden worden berekend op basis van de formule:
ti= het eenheidstarief van Nederlands-Antilliaanse guldens, waarvan de waarde periodiek wordt vastgesteld door de Minister van Toerisme, Economische Zaken, Verkeer en Telecommunicatie overeenkomstig de in de bij dit landsbesluit behorende bijlage opgenomen Standard rules for determination of en route air navigation facility charges.
d = factor afstand, gelijk aan het door honderd gedeelde aantal kilometers, gemeten langs de grootcirkel tussen:
het luchtvaartterrein waarvan wordt vertrokken of het punt waar het luchtruim als bedoeld in artikel 3, eerste lid, van de Landsverordening luchtvaartfaciliteitengelden wordt binnengevlogen en het luchtvaartterrein waarop de eerstvolgende landing wordt uitgevoerd of het punt waar het bovenbedoelde luchtruim wordt verlaten.
Deze punten worden gekozen met inachtneming van de meest gebruikelijke route tussen twee luchtvaartterreinen of, indien deze niet kan worden bepaald, de kortste route.
Bij elke start of landing wordt de afstand met twintig kilometer verminderd. De meest gebruikelijke route in de betekenis van de voorgaande alinea wordt jaarlijks uiterlijk op 1 november herzien ten einde rekening te houden met eventuele wijzigingen in het routestelsel of de verkeersstruktuur.
p = de vierkantswortel van het getal dat verkregen wordt door het maximaal toegelaten totaalgewicht ("maximum certificated take-off weight") van het luchtvaartuig uitgedrukt in tonnen te delen door 50, welke uitkomst zal worden uitgedrukt in een getal met 2 decimalen.
Wanneer een betalingsplichtige genoemd in artikel 3 van de Landsverordening luchtvaartfaciliteitengelden twee of meer luchtvaartuigen van hetzelfde type, maar in verschillende uitvoeringen te zijner beschikking heeft, zal als het gewicht voor de berekening als bedoeld in het vorige lid worden genomen het gemiddelde van de maximaal toegelaten totaalgewichten van de verschillende uitvoeringen.
Deze berekening zal tenminste ieder jaar worden herhaald. Mochten geen gegevens ter beschikking zijn gesteld, dan zal bij de berekening het gewicht van de zwaarste uitvoering van dat type luchtvaartuig worden genomen.

The number of service units designated as N, shall be obtained as follows:
The distance factor is the distance, expressed in hundreds of kilometers between:
-The aerodrome of departure of the point of entry into the Sint Maarten Flight Information Region (FIR) and the aerodrome of first (intended)landing or the point of exit from the Sint Maarten FIR.
A standard deduction of 20 km is made for each take-off or landing, to allow for the services provided by the Airport Approach facilities.
The distance factor has value of one for a flight of 100 km.
In the formula it is expressed as a figure taken tot 2 decimal places.
p = ------maximum certificated take-off weight
The certificated take-off weight of the aircraft is the weight as set out in the Certificate of Airworthiness, the Flight Manual or any other equivalent official document; expressed in metric tons.
The service unit thus corresponds to an aircraft weighing 50 metric tons and covering a distance of 100 km.
In the formula it is expressed as a figure taken tot 3 decimal places.
The service unit rate is the cost per service unit expressed in Netherlands Antillean Guilders (NAƒ) This figure is obtained by dividing the total costs for route air navigation facilities and services of the preceding year by the total service units rendered in the Sint Maarten FIR that year, being these units, the number of flight weighed with the distance factor (d) and the weight-factor (p).
TOTAL COSTS FOR ROUTE AIR NAVIGATION FACILITIES
The total costs for route air navigation facilities are obtained by taking into account the following:
Communication facilities and visual and radio aids to navigation, including radar, for safety and regularity of en route flights, including both air-to-ground and ground-to-ground communications when these are used directly or indirectly in connection with the preparation for, or the conduct of, a flight. Communications used for approach or aerodrome control are excluded, as also are the communication facilities used by the carriers for purely commercial purposes.
The service units rendered each year are calculated using the relevant civil aviation traffic statistics.
The charge is the total cost for each category of aircraft along the routes concerned.
The resulting charge (r) for each category of aircraft on the routes listed are rounded up to the nearest whole cent.
